Introduction

Welcome to Three Lefts NZ ("we", "our", "us").  As an artist, you play a vital role in our creative community. This document outlines the terms and conditions for your artist membership, explains how we handle your personal information, and includes additional requirements. Please read it carefully and feel free to reach out if you have any questions.

 

Terms and Conditions

1. Artwork Sales

   • All sales of your artwork displayed in our gallery or at festivals (including prints, stickers, etc.) must be conducted through our system.

   • We rely on the commission from sales to continue running 3Lefts. There is a 30% commission on all sales, split between 3Lefts, festival/event organizers, and staff.

   • Artists should factor this commission into their reserve prices for each piece.

   • Artists agree to pay the 30% commission even if buyers directly contact the artists. Buyers are required to make payments through our website, and 3Lefts will handle payments to the artists.

2. Artwork Display Requirements

   • When bringing pieces to be hung in our gallery, ensure they are ready for display (including hanging hooks or wire).

   • Use materials of decent quality appropriate for gallery display.

   • Plywood (ply) pieces should have a minimum thickness of 12mm to prevent warping.

   • Weather-seal your pieces and wrap them appropriately before handing them over to us.

3. Artwork Removal and Tracking

   • Communicate with us promptly if you wish to change pieces or display your work elsewhere.

   • Specify whether artwork displayed at festivals should default to our gallery in Kumeu.

   • We encourage artists to bring or swap new artwork frequently to engage the general public and other artists. This provides opportunities for the community to see fresh and diverse artwork.

   • Consider adjusting prices for unsold artwork after several months to ensure continued interest and sales.

4. User Content

   • You are responsible for the content you upload, post, or otherwise make available via the Service. You retain ownership of any intellectual property rights that you hold in that content.

5. Social Media Engagement

   • Follow us on social media, share and like our posts, and make posts tagging us and relevant artists, including yourself. This helps increase visibility and engagement for both our community and individual artists.

6. Disclaimer

   • By signing up for the 3Lefts membership, you confirm that all information provided is accurate and complete.

7. Termination

   • We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.

8. Limitation of Liability

   • To the maximum extent permitted by law, 3Lefts shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (i) your use or inability to use the service; (ii) any unauthorized access to or use of our servers and/or any personal information stored therein.

9. Governing Law

   • These Terms shall be governed and construed in accordance with the laws of New Zealand, without regard to its conflict of law provisions.

10. Changes to Terms

    • We reserve the right to modify or replace these Terms at any time without prior notice. Any changes will be effective immediately upon posting on this page. Your continued use of the service after any such changes constitutes your acceptance of the new Terms.
